Terms of Use for Spotr

1. Acceptance of Terms

By downloading, installing, or using Spotr ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. Description of Service

Spotr is an AI powered car identification and collection application. The App allows users to photograph vehicles and receive instant AI generated identification including make, model, year, rarity score, estimated value, and performance specifications. Users can build a digital collection of cars they have spotted in real life.

3. AI Identification Accuracy

The car identifications, rarity scores, and value estimates provided by Spotr are generated by artificial intelligence and are approximations based on visual analysis of photographs. These results are not guaranteed to be accurate and should not be relied upon for any commercial, financial, or legal purpose. Results may vary based on photo quality, lighting, angle, and vehicle condition. Spotr is not responsible for any decisions made based on AI generated identifications or valuations.

4. Photography and Privacy

When using Spotr you are solely responsible for ensuring that your photography activities comply with applicable laws and regulations in your location. You must not photograph vehicles in locations where photography is prohibited. You must not use Spotr to infringe upon the privacy rights of any individual. Spotr recommends that license plates be obscured or avoided when sharing or uploading photographs.

5. Subscriptions and Payments

Spotr offers subscription plans and lifetime purchase options. Payments are processed through the Apple App Store or Google Play Store. Payment will be charged to your account at confirmation of purchase.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time through your device account settings. No refund will be provided for the unused portion of a current subscription period.

A limited number of free scans are provided to new users. Full features require an active subscription or lifetime purchase.

6. User Content

By submitting photographs to the App for car identification, you grant Spotr a limited non-exclusive licence to process those images solely for the purpose of generating your car identification results. Your photographs are transmitted securely to our AI processing service and are not stored permanently on our servers beyond what is necessary to generate your results.

You must only submit photographs that you have the right to use. You must not submit photographs containing personally identifiable information of individuals without their consent.

7. Acceptable Use

You agree not to use the App in any way that is unlawful, harmful, or disruptive. You agree not to attempt to reverse engineer, decompile, or extract the source code of the App. You agree not to use the App to harass, harm, or intimidate any person or to infringe upon the rights of any third party.

8. Age Restriction

The App is intended for users aged 16 and over. By using the App you confirm that you are at least 16 years of age.

9. Intellectual Property

All content within the App including but not limited to the Spotr name, logo, design, AI identification system, and rarity scoring methodology is the intellectual property of Spotr and is protected by applicable intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Spotr shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to any decisions made based on AI generated car identifications, inaccurate valuations, or loss of data.

11. Changes to Terms

We reserve the right to modify these Terms of Use at any time. We will notify you of significant changes by updating the effective date at the top of this document. Your continued use of the App following any changes constitutes your acceptance of the updated terms.

12. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of England and Wales.
